Terms of Service

These Terms of Service (“Terms”) govern your use of the Echo mobile application developed by AYV Studio. By using Echo, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using Echo, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app. We reserve the right to modify these terms at any time, and your continued use of Echo constitutes acceptance of any changes.
2. Description of Service
Echo is a privacy-first iOS application that allows you to record time-locked video, audio, and text messages to your future self. Messages ("Echoes") are encrypted and stored locally on your device. Echo offers both free and premium tiers with varying feature access.
3. User Accounts
3.1 Account Creation
You may use Echo with Sign in with Apple, biometric authentication (Face ID / Touch ID), or without an account in local-only mode. You are responsible for maintaining the security of your device and any authentication methods you enable.
3.2 Account Security
You are solely responsible for all activity that occurs under your account or on your device. Echo uses AES-256-GCM encryption to protect your content. If you lose access to your device and do not have iCloud backup enabled, your data cannot be recovered. Echo is not responsible for any data loss resulting from device loss, damage, or failure to maintain backups.
4. Subscriptions and Purchases
4.1 Free Tier
Echo's free tier includes: up to 3 active locked Echoes at a time, a 2-minute recording limit per Echo, and standard lock functionality. Free tier features may change at our discretion.
4.2 Premium
Echo offers a one-time lifetime premium purchase that unlocks additional features including unlimited Echoes, extended recording time, all themes, iCloud backup, and early access to new features. The purchase is processed through Apple's App Store and is subject to Apple's terms.
4.3 Billing
Payment is charged to your Apple ID account at confirmation of purchase. No refunds are provided for partial periods, but you may request refunds through Apple.
4.4 Price Changes
We reserve the right to change prices. Any price changes will be communicated in advance and will not affect existing purchases.
5. Your Content
5.1 Ownership
You retain full ownership of all content you create in Echo, including videos, audio recordings, text entries, and reflections. Echo does not claim any intellectual property rights over your content.
5.2 Content Responsibility
You are solely responsible for the content you create and store in Echo. You agree not to use Echo to create, store, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
5.3 Time-Locked Content
Echoes that are time-locked cannot be accessed, modified, or deleted before their designated unlock date. This is a core feature of the app designed to preserve the integrity of messages to your future self. By locking an Echo, you acknowledge and accept that the content will be inaccessible until the unlock date, and that this restriction cannot be bypassed.
6. Privacy and Data
Your privacy is fundamental to Echo. Please refer to our Privacy Policy for detailed information about how we handle your data. Key points: all media content is stored locally on your device and encrypted with AES-256-GCM, we never access or transmit your videos, audio, or text content.
7. Acceptable Use
You agree not to: reverse engineer, decompile, or disassemble the app; attempt to circumvent the time-lock mechanism or encryption; use the app for any unlawful purpose; distribute, sublicense, or resell access to the app; interfere with or disrupt the app's functionality; or use automated systems to access the app in ways not intended by its design.
8. Intellectual Property
Echo, including its design, code, features, and branding, is the intellectual property of AYV Studio. All rights not expressly granted in these terms are reserved. The Echo name, logo, and associated trademarks may not be used without our prior written consent.
9. Disclaimers
9.1 No Warranty
Echo is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9.2 Data Loss
While we implement strong encryption and security measures, we cannot guarantee absolute security. We are not liable for any data loss resulting from device failure, software errors, unauthorized access to your device, or any other cause beyond our reasonable control. We strongly recommend enabling iCloud backup.
10. Limitation of Liability
To the maximum extent permitted by applicable law, AYV Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of Echo.
11. Termination
You may stop using Echo at any time by deleting the app from your device. You may delete all data through Settings > Delete All Data before uninstalling. We reserve the right to suspend or terminate access to Echo if you violate these terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these terms or your use of Echo shall be resolved through binding arbitration, except where prohibited by law.
